ONC Releases 2019 Long-Awaited Interoperability and “Data Blocking” Rule

On February 11, the U.S. Department of Health and Human Services’ (HHS) Office of the National Coordinator for Health IT (ONC) issued its long-awaited proposed rule to “support seamless and secure access to, exchange of, and use of electronic health information (EHI).”

The proposed rule is the next step in implementing provisions of the 21st Century Cures Act related to “information blocking”. In addition to outlining a definition, exceptions and penalties for information blocking, the proposed rule would require that patients be permitted to “electronically access their EHI at no cost.”

In its press release, ONC highlighted a request for information regarding price information within the scope of EHI and encouraged stakeholders to provide public comments through the Federal Register online submission process.
