With the November 2 information blocking deadline approaching, NextGen Healthcare reminds clients to familiarize themselves with the key provisions of the regulation and obligations for providers.
The Office of the National Coordinator for Health IT (ONC) has authority under 45 CFR subpart 170 to enforce the information blocking provisions of 21st Century Cures starting six (6) months from the publication of the final rules (i.e., November 2, 2020). The final enforcement date and the associated penalties are yet to be announced, pending a final rule from the Office of the Inspector General (OIG). While NextGen Healthcare anticipates the OIG will delay enforcement until early 2021, we urge clients to prepare in advance of the November 2 regulatory deadline.
Providers are required to respond to reasonable data sharing requests from patients and other providers. Your NextGen® Enterprise software can help you maintain compliance with the rule, but this compliance responsibility rests on your practice.
